1. Validity of general terms and conditions

unless otherwise expressly agreed, our terms and conditions, which have been announced to the contractual partner, apply. Our contractual partner agrees that in the case of the use of GTC by him in case of doubt our conditions shall be assumed, even if the conditions of the contractor remain uncontested. We deliver exclusively to our terms and conditions, which are based on all contracts concluded with and on the basis of the offers given by mail, telephone and the offers on our internet page. If in the terms and conditions consumer are mentioned, we refer to natural persons & companies.

The terms & conditions on our homepage are available in German and English.

The prices indicated on our homepage are final prices, ie. they contain the applicable value added tax in Austria.

The possible transport costs for destinations in Europe are clearly communicated by email and for all other destinations these will be communicated, once the order has been confirmed & accepted from our side.

We deliver by parcel service / mail to your home address or to a different, specified delivery address.

We try to deliver your order as soon as possible, as all our products are produced fresh for a perfect taste and a long shelve-life.

The obligation to deliver is void if we ourselves are not supplied correctly or on time as we cannot be responsible for the lack of availability. In case of unavailability of the goods you will be informed immediately. In this case, you have the right to withdraw from the contract. Any prepaid payments will be refunded immediately.

For consumers, the risk of accidental loss and accidental deterioration of the goods, packages has to be claimed from the parcel service / mail at the costumer destination.

2. Use of data

we point out that your order and address data are stored. The storage and use of your data takes place as far as necessary in the context of order processing (and by submitting the used order processing partners or shipping partners), the accounting department for possible warranty cases, as well as for their own advertising purposes. You can revoke the use of your data for promotional purposes at any time by sending an @mail to office@wk-schokolade.at.

On various pages on our internet page we use so-called cookies to make visiting our websites attractive and to enable the use of certain functions. These are small text files that are stored on your computer. Most of the cookies we use are deleted from your hard drive after the browser session is over. Other cookies remain on your computer and allow you to recognize your computer on your next visit. Our partner companies are not permitted to collect, process or use personal data via cookies via our website.

3. Electronic accounting

Our customer agrees that invoices to him are also created and transmitted electronically.

4. Place of performance

The place of performance for both our shipments & services is the Vienna office of our company in A-1010 Vienna, Fischerstiege 10/15, Austria.

5. Non-fulfillment / delay in delivery and performance

The buyer accepts slight delivery time overruns in any case without the customer being entitled to a claim for damages or a right of withdrawal.

6. Warranty

We reserve the right to fulfill the warranty claim at our own choice through improvement, replacement or price reduction. The transferee must always prove that the defect was already present at the time of transfer. The goods must be inspected immediately after delivery. Any defects found shall be notified to the seller immediately as well, but no later than within 3 days of delivery, stating the nature and extent of the defect. Hidden defects must be reported immediately after their discovery. If a complaint is not made or not collected in time, the goods are considered as approved.

7. Product Liability

Any claims are excluded, unless the person entitled to recourse proves that the error has been caused in our sphere or has been caused by a gross negligence.

8. Offsetting

A set-off against our claims with counterclaims, of whatever kind, is excluded.

9. Formal requirements

All agreements, subsequent changes, additions, etc. must be in written in order to be valid.

10. Place of jurisdiction

This contract shall be governed by Austrian law.
